Synopsis:  This Resolution is being presented by City Council for Council’s review and approval. This Resolution declares 1124 East Seventh Street and 1112 East Seventh Street to be surplus and approves a long-term lease with the Kalmar Nyckel Foundation, and approves the properties for disposition to the Kalmar Nyckel Foundation should it exercise a future purchase option.

Synopsis: This Ordinance is being presented by the Administration for Council’s review and approval. This Ordinance authorizes the City to exercise its option to extend contract 19048PR – Summer Food Service Program – between the City of Wilmington and Preferred Meal Systems, Inc. for the 2020 Summer Food Service Program at an estimated price of Six Hundred Fifty-Eight Thousand, Ninety-Eight Dollars ($658,098.00) based on an estimated number of meals at the price of $1.52 per Individual Breakfast, $2.59 per Individual Lunch, and $2.59 per Individual Supper.

Synopsis: This Resolution is being presented by the Administration for Council’s review and approval. This Resolution authorizes the Department of Parks and Recreation’s application to the Bank of America Charitable Foundation in the amount of $65,000. The funds will be used to support the City’s 2019 Summer Youth Employment Program. No local matching funds are required.

Synopsis: This Resolution is being presented by the Administration for Council’s review and approval. This Resolution authorizes the Department of Parks and Recreation’s application for a grant from Christiana Care Health Services in the amount of $35,210. The grant will enable the City to supplement its offerings in the Wilmington Play Streets initiative that will provide children a safe place to play and adults a safe place to learn about available resources. No local matching funds are required.

Synopsis: This Resolution is being presented by the Administration for Council’s review and approval. This Resolution approves the First Amendment to a License Agreement between the City and T-Mobile Northeast, LLC (“T-Mobile”), which permits T-Mobile to install and operate communications antennas on and a control cabinet at the base of the City’s water tower located on or near 6 Newark Union Road, Wilmington, Delaware. The First Amendment will: 1) extend the term of the License Agreement for an additional five (5) years commencing on March 10, 2010; 2) increase the license fee payable by T-Mobile to the City under the License Agreement to $50,400 per year with an increase of three percent (3%) annually commencing on March 10, 2020; and 3) provide T-Mobile with an option to renew the License Agreement for two (2) additional terms of five (5) years thereafter.

Synopsis: This Ordinance is being presented by the Administration for Council’s review and approval. This Ordinance authorizes the execution of Contract 20001PW – HVAC Preventative Maintenance – between the City of Wilmington and Summit Mechanical, Inc. for the period of one (1) year from July 1, 2019 through June 30, 2020, at an estimated price of Thirty-Four Thousand, Two Hundred Forty-Five Dollars ($34,245.00), with the possibility of two (2) additional extensions of one (1) year thereafter at the same annual price, at the option of the City.

Synopsis: This Ordinance is being presented by the Administration for Council’s review and approval. This Ordinance authorizes the execution of Contract 20002CW – Security Guard Service – between the City of Wilmington and Security Guard, Inc. t/a Gettier Security for the period of one (1) year from July 1, 2019 through June 30, 2020, at an estimated price of Eighty-Six Thousand, Two Hundred Forty Dollars ($86,240.00), with the possibility of two (2) additional extensions of one (1) year thereafter at the same annual price, at the option of the City.

Synopsis: This Ordinance is being presented by the Administration for Council’s review and approval. This Ordinance authorizes the City to enter into a twenty-year energy performance contract (the “Contract”) for upgrading the City’s existing street lights to a new, smart technology LED street light system beginning on July 1, 2019 at an estimated total price of Two Million, Two Hundred Ninety-Four Thousand, Eight Hundred Eighty-Three Dollars ($2,294,883). The Contract will enable the City to realize a long-term energy efficiency by reducing the energy consumption of the City’s street lighting system by an estimated seventy percent (70%). The Contract will also create an estimated yearly cost savings to the City of One Hundred Fifty-Four Thousand Thirty-Eight Dollars ($154,038) and an overall cost savings to the City of between Three Million Dollars ($3,000,000) and Four Million Dollars ($4,000,000).

Synopsis: This Substitute Ordinance is being presented by City Council for Council’s review and approval. This Substitute Ordinance amends Chapter 5 of the City Code requiring businesses that sell tobacco products, electronic smoking devices, or tobacco paraphernalia to place such items behind a counter in an area that is not accessible to customers without the intervention of an employee of the business so as not to be placed within the reach of children. The State of Delaware Department of Homeland Security Division of Alcohol and Tobacco Enforcement has expressed an interest in helping the City to identify businesses that do not comply with this amended section of the City Code.

Synopsis: This Ordinance is being presented by the Administration for Council’s review and approval. Pursuant to City Code Section 39-6(c), this Ordinance implements the City of Wilmington Pension Commission’s recommendation for Fiscal Year 2020 for a one-time stipend of one thousand dollars ($1,000), in lieu of a cost of living adjustment, to all City of Wilmington uniform and nonuniform pension benefit recipients receiving an annual benefit payment of less than twenty thousand dollars ($20,000). The disbursement of this stipend will occur in July 2019.

Synopsis: This Substitute Ordinance is being presented by the Council for Council’s review and approval. This Substitute 1 to Ordinance No. 19-026 (“Ordinance”) amends Chapter 5 section 5-101 entitled “Schedule of Fees” by amending the section to increase the business license fee for rental dwelling units to $100 per unit, not to exceed a total business license fee of $10,120.00. This Ordinance amends Chapter 34 of the City Code by changing the enforcement of Chapter 34 with respect to vacant and rental properties from criminal enforcement to civil enforcement with civil fines for non-compliance. The Ordinance also makes additional changes to update and modernize Chapter 34. In addition, this Ordinance amends Chapter 4 by deleting Section 4-27, 119.0 (authorization for exterior improvements to vacant structures) and Section 4-27, 120.0 (annual vacant property registration fees) and incorporates these provisions into Chapter 34. Further, this Ordinance amends the annual vacant property registration fee provisions (previously found at Chapter 4, Section 4-27, 120.0; now located at Chapter 34, Section 34-210) to: (1) increase the registration fees for properties vacant 3 or more years; (2) require registration of buildings vacant for 6 consecutive months rather than 45 consecutive days; (3) impose a civil fine of $500.00 for failing to register a vacant building within 30 days of the required time to register; (4) exempt vacant buildings owned by the Wilmington Neighborhood Conservancy Land Bank Corporation (“Land Bank”) from registration requirements; and (5) provide that purchasers of a vacant building from the Land Bank be billed a vacant registration fee based on the duration of vacancy from the time he or she received the building from the Land Bank, rather than a vacant registration fee based on the duration of the vacancy prior to receiving the building.

Synopsis: This Ordinance is being presented by the Administration for Council’s review and approval. This Ordinance authorizes the issuance of up to $8,600,000 aggregate principal amount of General Obligation Bonds (the “Bonds”) and up to $8,600,000 aggregate principal amount of a General Obligation Bond Anticipation Note (the “Note”) in order to: (i) provide temporary and permanent financing for street repairs and improvements of various streets and roadways located within the City limits; (ii) provide temporary and permanent financing for satisfaction of an outstanding debt incurred by the Wilmington Housing Partnership; and (iii) to pay the costs associated with issuance of the Bonds and the Note.
