Synopsis:  This Ordinance is being presented by the Administration for Council’s review and approval. This Ordinance amends Chapter 48 of the City Code to define indoor commercial horticultural operations and certain related terminology and to permit indoor commercial horticultural operations as a matter of right within M-1 (Light Manufacturing), C-5 (Heavy Commercial), W-1 (Waterfront Manufacturing), W-2 (Waterfront Manufacturing/Commercial), and W-3 (Waterfront Low Intensity Manufacturing/Commercial Recreation) zoning districts.  This Ordinance also establishes parking requirements for indoor commercial horticultural operations.

This Resolution schedules a public hearing on July 11, 2019 at 6:30 p.m. in the City Council Chambers regarding the proposed ordinance to amend Chapter 48 of the City Code to permit indoor commercial horticultural operations as a matter of right within M-1 (Light Manufacturing), C-5 (Heavy Commercial), W-1 (Waterfront Manufacturing), W-2 (Waterfront Manufacturing/Commercial), and W-3 (Waterfront Low Intensity Manufacturing/Commercial Recreation)) zoning districts.

This Ordinance authorizes the City to exercise its option to extend Contract 19048PR – Summer Food Service Program – between the City of Wilmington and Preferred Meal Systems, Inc. for the 2020 Summer Food Service Program at an estimated price of Six Hundred Fifty-Eight Thousand, Ninety-Eight Dollars ($658,098.00) based on an estimated number of meals at the price of $1.52 per Individual Breakfast, $2.59 per Individual Lunch, and $2.59 per Individual Supper.

Synopsis: This Resolution is being presented by the Administration for Council’s review and approval. This Resolution authorizes the Department of Parks and Recreation to accept the donation of a portion of the I-95 Right-of-Way, as fully described and depicted in Exhibit “A”, from the State of Delaware, Department of Transportation, in order to construct a Skate Park Recreation Facility.

Synopsis: This Resolution is being presented by the Administration for Council’s review and approval. This Resolution authorizes the Department of Public Works’ application for a grant from the grantors in the amount of $110,000. This grant will enable the City to conduct a Hoopes Reservoir Interconnection Study for the City of Wilmington with the goal of increasing accountability and strengthening sustainability of the City’s water supply. There is a required 100% local match.

Synopsis: This Resolution is being presented by the Administration for Council’s review and approval. This Resolution authorizes the Wilmington Fire Department’s application for a grant from FEMA in the amount of $24,000. The grant will enable the City to fund two separate communications projects that will allow secure communications within the agency and with other public safety agencies.

Synopsis: This Resolution is being presented by the Administration for Council’s review and approval. This Resolution authorizes the Wilmington Fire Department’s application for a grant from FEMA in the amount of $108,700. The grant will enable the City to obtain a vessel-mounted radiation detection system which will increase the safety of passengers and will also be able to identify potential weapons of mass destruction.

Synopsis: This Resolution is being presented by the Administration for Council’s review and approval. This Resolution authorizes the Wilmington Police Department’s application for a grant from the Delaware CJC in the amount of $100,000. The grant will enable the Wilmington Police Department to fund the testing of Sexual Assault Kits (“SAK”) to identify evidence, prosecute suspects, and provide support to victims of sexual assault.

Synopsis: This Resolution is being presented by the Administration for Council’s review and approval. This Resolution authorizes the Office of Emergency Management’s application for a grant from FEMA/SOD/DEMA in the amount of $211,905. The grant will enable the City to provide a system of emergency preparedness for the protection of life and property. There is a 50% local match requirement.

Synopsis: This Resolution is being presented by the Administration for Council’s review and approval. This Resolution authorizes the Wilmington Police Department’s application for a grant from the Delaware Department of Safety and Homeland Security in the amount of $50,000. The grant will enable the Wilmington Police Department to prosecute violent crime using DNA and other forensic testing to identify suspects and to decrease the number of violent crime cold cases awaiting prosecution.

Synopsis: This Resolution is being presented by City Council for Council’s review and approval. This Resolution recognizes June as Re-Entry Month and strongly encourages the Delaware General Assembly to also recognize June as Re-Entry Month in Delaware.

Synopsis: This Ordinance is being presented by the Administration for Council’s review and approval. Pursuant to City Code Section 39-6(c), this Ordinance implements the City of Wilmington Pension Commission’s recommendation for Fiscal Year 2020 for a one-time stipend of one thousand dollars ($1,000), in lieu of a cost of living adjustment, to all City of Wilmington uniform and nonuniform pension benefit recipients receiving an annual benefit payment of less than twenty thousand dollars ($20,000). The disbursement of this stipend will occur in July 2019.

Synopsis: This Substitute Ordinance is being presented by the Administration for Council’s review and approval. This Substitute Ordinance authorizes the issuance of up to $15,600,000 aggregate principal amount of General Obligation Bonds (the “Bonds”) and up to $15,600,000 aggregate principal amount of General Obligation Bond Anticipation Notes (the “Notes”) in order to: (i) provide temporary and permanent financing for street repairs and improvements of various streets and roadways located within the City limits; (ii) provide temporary and permanent financing for the refinancing of any outstanding City debt related to the Wilmington Housing Partnership; and (iii) to pay the costs associated with issuance of the Bonds and the Notes.

Synopsis: This Resolution is being presented by the Administration for Council’s review and approval. This Resolution supports the City’s application to the State of Delaware to expand the boundaries of the City’s Downtown Development District as illustrated on the map attached hereto as Exhibit “A”. In addition, this Resolution appoints the City’s Director of the Department of Planning and Development to serve as the District Administrator for the City’s Downtown Development District. This Resolution supersedes Resolution 19-019.

Synopsis: This Resolution is being presented by the Administration for Council’s review and approval. This Resolution authorizes the Department of Real Estate and Housing’s application for a grant from HUD in the amount of $4.1 Million.  The grant will enable the City, in partnership with the New Castle County Department of Community Services, to identify and control lead-based paint and healthy homes hazards in eligible housing.  There is a required $65,000 yearly local match.

Synopsis: This Ordinance is being presented by City Council for Council’s review and approval. This Ordinance amends Ordinance No. 19-011 to delete the $3,400,000 Real Estate and Housing project entitled “Housing Partnership Debt Assumption” (the “Project”) from the Capital Program for the six Fiscal Years 2020-2025 (the “Capital Program”). The deletion of the Project from the Capital Program will reduce the total amount of the Capital Program to $273,047,605, as set forth on Attachment A.  The total amount includes a reduction of $3,400,000 for the Project and $42,500 in the cost of bond issuance.

Synopsis: This Ordinance is being presented by City Council for Council’s review and approval. This Ordinance amends Ordinance No.19-012 to reduce the total amount of the Capital Budget for Fiscal Year 2020 to $76,391,410 to conform with the amendment to the Capital Program for the six Fiscal Years 2020-2025 that deletes the Real Estate and Housing project entitled “Housing Partnership debt Assumption” (the “Project”).  The total amount includes a reduction of $3,400,000 for the Project and $42,500 in the cost of bond issuance.
