An Ordinance to Amend Chapter 48 of the City Code to Provide a Mandatory Inclusionary Housing Program for Low-to Moderate-Income Residents and Establish an Affordable Housing Trust

Synopsis:  This Ordinance is being presented by City Council for Council’s review and approval.  This Ordinance amends Chapter 48 of the City Code by establishing a mandatory inclusionary housing program and a housing trust that is intended to help address the severe shortage of affordable housing in the city.

An Ordinance to Amend Chapter 48 of the City Code to Require the Department of Land Use and Planning to Notify City Council of Building and Demolition Permits and Waterfront Development Project

Synopsis:  This Ordinance is being presented by City Council for Council’s review and approval.  This Ordinance amends Chapter 48 of the City Code by adding procedures wherein the Department of Land Use and Planning will provide copies of application for building permits, demolitions, minor waterfront developments, and major waterfront developments to City Council within ten (10) business days of receipt of any such application.

A Resolution Appealing to the Delaware General Assembly to Amend Section 2-204 of the City of Wilmington Home Rule Charter to Exempt August and December from the Obligatory Monthly Meeting Requirements

Synopsis:  This Resolution is being presented by City Council for Council’s review and approval.  This Resolution urges the Delaware General Assembly to enact legislation that will amend City Charter § 2-204 to exclude August and December from the twice-a-month meeting requirement except when a meeting is requested by the Mayor, President of City Council, or a majority of the City Council. Like many other public institutions, the City of Wilmington is experiencing staffing shortages and ongoing financial concerns. It is the sense of this Council that the amendment to Section 2 of the City of Wilmington Home Rule Charter bolsters efficiency, productivity, accountability, and transparency in a manner that is cognizant of the present realities and resource constraints experienced by this municipality in accordance with the 2022-2025 Strategic Plan Goals of “Transparent and Well-Represented Wilmington;” “Connected, Informed and Engaged Wilmington;” and maintenance of a “Prosperous and Sustainable Wilmington.”

Synopsis:  This Resolution is being presented by the Administration for Council’s review and approval. This Resolution schedules a public hearing on April 4, 2024 at 6:30 p.m. in the City Council Chambers regarding an ordinance proposing amendments to the large-scale redevelopment project known as “The Wilmington Flats.”  Members of the public will be allowed to participate in the public hearing (i) in person in the City Council Chambers and (ii) virtually in accordance with 29 Del. C. § 10006A. The instructions for virtual participation will be provided on the agenda for April 4, 2024 Council meeting.

An Ordinance to Amend Chapter 42 of the City Code Regarding Permits for Certain Residential Property Owners and Occupants to Use, Install, and Maintain Curbside Charging Cords and Electric Vehicle Charging Stations in the Public Right-of-Way

SynopsisThis Ordinance is being presented by the Administration for Council’s review and approval. This Ordinance amends Chapter 42, Article III, Division 3 of the City Code, a division that creates a procedure for residents to obtain permits for the use and installation of curbside charging cords and electric vehicle charging stations in the public right-of-way, with the recommended changes of the Electric Vehicle Working Group charged with that task.  Among other things, this Ordinance: (i) harmonizes the definition of electric vehicle with State law; (ii) allows a frequent operator/non-owner of an electric vehicle to obtain a permit for a charging station or cord; (iii) clarifies that when the permit holder and property owner are not the same person the property owner is jointly responsible for code compliance; (iv) allows the City to grant a variance for a property owner with off-street parking on the owner’s property to have a charging station if parking conditions in the neighborhood permit; (v) sunsets the curbside charging cord permitting process if not reenacted by July 1, 2030; and (vi) corrects unintended typographical and grammatical errors.
