This Resolution issues a censure of Council Member Zanthia Oliver, following the City of Wilmington Ethics Commission’s second public reprimand in a calendar year and the City Auditor’s report detailing conflicts of interest.

An Ordinance to Amend Chapter 45 of the City Code to Authorize a Water Affordability Assessment

Synopsis:  This Ordinance is being presented by City Council for Council’s review and approval. This Ordinance amends Chapter 45 of the City Code to authorize the Department of Finance to retain an outside vendor to make recommendations concerning the creation of an affordable water program and the setting of water assessment rates. The Ordinance also permits the Department, after review, to accept in whole or in part, or to reject these recommendations.

Synopsis:  This Ordinance is being presented by the Administration for Council’s review and approval. This Ordinance amends Section 40-371 of the City Code to increase the annual shoe allowance for employees who are not covered by a collective bargaining agreement and who are required to wear safety shoes by their respective department head to One Hundred Fifty Dollars ($150.00).

Synopsis:  This Ordinance is being presented by City Council for Council’s review and approval. This Ordinance amends Chapter 2 of the City Code by creating additional penalty for Elected Officials who have allegations of financial ethical violations against them substantiated by the Wilmington Ethics Commission.

An Ordinance Authorizing the Issuance of the City’s General Obligation Bond (Water Distribution & Transmission Improvements – Lead Removal Phase II Project), Series C of 2024-DWSRF, in Order to Provide the Funds Necessary for the Continuing Replacement of Watermains in City’s Distribution System; Providing for the Sale of the 2024C Bond to the Delaware Drinking Water State Revolving Fund; and Authorizing Other Necessary Action

Synopsis:  This Ordinance is being presented by the Administration for Council’s review and approval. This Ordinance authorizes the issuance of a General Obligation Bond (Water Distribution & Transmission Improvements – Lead Removal Phase II Project), Series C of 2024-DWSRF, in an amount not to exceed $10,000,000 (the “2024C Bond”), which will be sold to the Delaware Drinking Water State Revolving Fund in order to (i) finance a project consisting of the continuing elimination of any exposure potable water may have with lead material in the City’s distribution system by the replacement of old cast iron pipe with modern day cement-lined, ductile iron pipe with an engineered rubber gasket, with the expectation the City will replace approximately four miles of watermains in its distribution system, as set forth in the City’s capital budgets for its Fiscal Years ending June 30, 2022 and June 30, 2024, (ii) pay administrative costs relating to such capital projects, and (iii) pay the costs of issuing the 2024C Bond.

Synopsis:  This Ordinance is being presented by the Administration for Council’s review and approval. This Ordinance authorizes the issuance of a General Obligation Bond (11th Street Sewage Pump Station Replacement/Upgrades – Screening Project), Series B of 2024-WPCRF, in an amount not to exceed $2,500,000 (the “2024B Bond”), which will be sold to the Delaware Water Pollution Control Revolving Fund in order to (i) finance the replacement of a screen at the City’s 11th Street Sewage Pump Station to decrease the debris passing to the new Dry Weather Pump Station, as set forth in the City’s capital budget for its Fiscal Year ending June 30, 2024, (ii) pay administrative costs relating to such capital projects, and (iii) pay the costs of issuing the 2024B Bond.

An Ordinance to Amend Chapter 37 of the City Code Relating to the Collection of Parking Fines

Synopsis:  This Ordinance is being presented by the Administration for Council’s review and approval. This Ordinance amends Chapter 37 of the Wilmington City Code to 1) allow the Director of Finance greater flexibility when entering into payment plans by deleting the three-month time limitation on such plans; 2) permit a vehicle owner to obtain a release for a vehicle that has been immobilized or impounded when the owner enters into a payment agreement that is authorized by the Department of Finance; 3) require that outstanding civil penalties and fees imposed under this Chapter be voided when, pursuant to a State-authorized process, title to a vehicle that has been impounded is transferred to the towing or storage contractor, or the towing or storage contractor obtains authority to dispose of the vehicle; and 4) clarify that appeals related to immobilization and towing will be heard by a hearing officer employed or contracted by the City in accordance with regulations adopted by the Department of Finance.
