Authorize and Approve a License Agreement Between the City of Wilmington and Environmental Systems Research Institute, Inc.

Synopsis:  This Ordinance is being presented by the Administration for Council’s review and approval. This Ordinance authorizes the City  to enter into a license agreement with Environmental Systems Research Institute, Inc. for access to software to apply geographic  information system technology to many operational and technical areas within the City for a period of three (3) years from September 22,  2024 through September 21, 2027.

An Ordinance to Establish a Temporary Moratorium on the Formal Position Classification Biennial Appeals Process

Synopsis:  This Ordinance is being presented by the Administration for Council’s review and approval. This Ordinance establishes a temporary moratorium on the formal position classification biennial appeals process set forth in City Code Section 40-86 in  order for the Department of Human Resources to meet with all City departments to evaluate their respective organizational structures and position classifications to ensure that (i) operational needs are being met efficiently and (ii) each employee’s duties and responsibilities are accurately captured in their respective position descriptions.

An Ordinance Authorizing the Issuance of the City’s General Obligation Bonds and General Obligation Bond Anticipation Note in Order to Provide the Funds Necessary to Finance Various Capital Projects Specified in the City’s Fiscal Year 2022 and 2024 Capital Budgets; Providing for the Sale of the Bond and the BAN; and Authorizing Other Necessary Action

Synopsis:  This Ordinance is being presented by the  Administration for Council’s review and approval. This Ordinance (i) authorizes the issuance of up to $20,000,000 aggregate principal amount of General Obligation Bonds (the “Bonds”) and up to $20,000,000 aggregate principal amount of a General Obligation Bond Anticipation Note (the “BAN”) in order to (a) provide temporary and permanent financing for any duly authorized capital project of the City specified in the City’s capital budgets for its Fiscal Years ending June 30, 2022 and June 30, 2024 and (b) pay the costs associated with issuance of the Bonds and the BAN, and (ii) amends certain prior bond ordinances to authorize the use of any proceeds remaining from the prior bonds that have not been expended to (x) finance any duly authorized capital project of the City specified in the City’s various, prior capital budgets enacted prior to and including the Fiscal Year 2024 capital budget, (y) finance any other capital project authorized by the City in any capital budget for any fiscal year subsequent to the date hereof, and/or (z) make any debt service payments due, or which become due, on such prior bonds, or bonds that refunded such prior bonds, as appropriate, all as determined by the Bond Committee.

Amend Chapter 37 of the City Code Relating to Collection of Parking Fines

Synopsis:  This Ordinance is being presented by the Administration for Council’s review and approval. This Ordinance amends Chapter 37 of the Wilmington City Code to 1) allow the Director of Finance greater flexibility when entering into payment plans by deleting the three-month time limitation on such plans; 2) permit a vehicle owner to obtain a release for a vehicle that has been immobilized or impounded when the owner enters into a payment agreement that is authorized by the Department of Finance; 3) require that outstanding civil penalties and fees imposed under this Chapter be voided when, pursuant to a State-authorized process, title to a vehicle that has been impounded is transferred to the towing or storage contractor, or the towing or storage contractor obtains authority to dispose of the vehicle; and 4) clarify that appeals related to immobilization and towing will be heard by a hearing officer employed or contracted by the City in accordance with regulations adopted by the Department of Finance.

A Resolution Approving the Acceptance by the Department of Land Use and Planning of Grant Funds from Delaware 250 to Support Documentary Research Regarding Caesar Rodney and the Development of Updated Interpretive Public History

Synopsis:  This Resolution is being presented by the Administration for Council’s review and approval. This Resolution authorizes the Department of Land Use and Planning to accept grant funds in the amount of $10,000.00 from Delaware 250, an undertaking of the Delaware Heritage Commission to commemorate the 250th anniversary of America’s and Delaware’s independence.  The grant funds will be used to fund fresh documentary research on Delaware statesman and founder, Caesar Rodney, with an emphasis on his personal life and his role as an enslaver with the resulting report being used to aid in the development of updated interpretive public history.  No local matching funds are required.

A Resolution Authorizing the Mayor to File a Second Substantial Amendment to the City Fiscal Year 2024/Federal Fiscal Year 2023 Annual Action Plan with the U.S. Department of Housing and Urban Development

Synopsis:  This Resolution is being presented by the Administration for Council’s review and approval. This Resolution authorizes the Mayor, or his designee, to file a Second Substantial Amendment to the City Fiscal Year 2024/Federal Fiscal Year 2023 Annual Action Plan with the U.S. Department of Housing and Urban Development, which provides for (i) an increase of $300,000 to the First-Start Homebuyers Program with $50,000 for program delivery and (ii) $100,000 of the funding for the Villa Maria project initially included as a public improvement project will instead be used for demolition of the buildings on the site.

Approving a Five-Year Extension of the Comcast Franchise Agreement

Synopsis:  This Ordinance is being presented by City Council for Council’s review and approval. This Ordinance authorizes the City to enter into an Extension of its Franchise Agreement with Comcast of New Castle County, LLC that provides Comcast of New Castle County with a five year, non-exclusive franchise to construct, install, maintain, and operate a cable system in the City.
